for members of the HOME BUILDERS ASSOCIATION OF HARTFORD COUNTY, INC.

This Code of Ethics & Performance Guidelines (“Code”) for members of the Home Builders Association of Hartford County has been adopted to promote and maintain the highest standards of service and conduct in the building industry and among its members. Adherence to this Code is required of association members to assure public confidence in the integrity and service of the HBA and its members. Enforcement of this Code is initiated by the filing of a written complaint with the HBA’s Ethics Committee (or other named committee or third party dispute resolution firm that may be contracted by the HBA) concerning a dispute involving the member’s business or an alleged violation of this Code.

Limitations: Proceeding with any HBA dispute resolution process or taking any enforcement action concerning an HBA member will be determined, at the HBA’s sole discretion, by factors including, but not limited to, whether a credible alternative dispute resolution or regulatory or judicial relief process is available to the parties through another organization or government agency; the results of such alternative process(es); and the nature, degree, and scope of the complaint or alleged violation of this Code. The HBA shall in each instance of proceeding with dispute resolution or enforcing this Code follow established, written procedures, which include the provision of reasonable due process to the parties and the scope of enforcement that may be imposed by the HBA on its members.

Each member shall use best efforts in the conduct of its business activities to:

  • Abide by the bylaws, rules and procedures of the HBA.
  • Comply with all applicable registration and licensing laws.
  • Comply with all applicable warranty laws and building codes.
  • Conduct all transactions, agreements, and dealings with customers, employees, subcontractors, and regulatory officials free from fraud or deception and comply with the requirements of the Connecticut Unfair Trade Practice Act.
  • Comply with all other applicable local, state, and federal laws and regulations.
  • Maintain insurance as may be required by law, including but not limited to general liability and worker’s compensation insurance, at a level that is adequate and customary for the business in which the member is engaged.
  • Where applicable, meet or exceed the latest edition of the Residential Construction Performance Guidelines for Professional Builders and Remodelers, published by the National Association of Home Builders, as may from time to time be supplemented by the HBA of Connecticut, Inc.
  • If the HBA chooses to proceed with its dispute resolution process or review an alleged violation of this code (see Limitations above), agree to participate in and comply with the outcome of the HBA’s dispute resolution process, and agree to participate in and comply with any enforcement action taken by the HBA pursuant to the HBA’s code violation process.
  • Agree that this Code applies to all corporations, partnerships, and other business entities in which the member or a principle of the member has a majority interest.
